TSCA Restricted Substances: Exemption Information

While the 2021 restrictions of persistent, bioaccumulative, and toxic (PBT) substances under the U.S. Toxic Substances Control Act (TSCA) affect a wide range of industries and use cases, there are certain established exemptions. Here are the exemptions for each restricted PBT substance.

2,4,6-Tri-tert-butylphenol, CAS 732-26-3

The restrictions on 2,4,6-Tri-tert-butylphenol do not take effect until January 6, 2026, so they may be considered to under a blanket exemption until that point. However, companies may find it helpful to collect data in the meantime in order to be prepared when restrictions take effect.

Decabromodiphenyl ether (decaBDE), CAS 1163-19-5

While restrictions took effect in early 2021 for manufacturers of decaBDE, restrictions did not take effect for distributors until January 6, 2022.
