Proposition 65 Labels on Product Documentation

Question: Can the proposition 65 warning be placed on the installation sheet or product information sheet only, rather than on the product itself?

Answer: Businesses are required to provide a "clear and reasonable" warning before knowingly and intentionally exposing anyone to a listed chemical. Because the warning must be visible to the consumer prior to purchase or exposure, it cannot be in the installation or product information sheet unless those are available to the consumer prior to purchase or exposure. Additionally, the regulation stresses that warnings should be conspicuous and likely to be read and understood.

 If a consumer purchases the product via a website, the warning must be provided to the consumer before the product is purchased The warning or a link to the warning should be on the same page as the product.
