IMPORTANT: This guideline is for information purposes only and does not constitute legal advice. It provides guidance for companies communicating the presence of substances documented under Article 11 of Directive 94/62/EC on packaging and packaging waste.
- Produce them on company letterhead.
- Needs to indicate that the declaration is an official company communication of the employee making the declaration.
- Include the proper legislative reference.
- Include the actual title of the legislation the declaration is being produced to comply with (e.g. the European Parliament and Council Directive 94/62/EC of 20 December 1994 on packaging and packaging waste last amended by Directive 2018/852).
- Other acceptable references:
- Directive 94/62/EC.
- Directive 94/62/EC (amendment 2018/852).
- EU Directive 94/62/EC and amendment 2018/852.
- Include a unique reference to the packaging material(s) covered by the declaration.
- Declare compliance status.
- State that the declaration does not include any of the substances defined by the directive.
- State that the declaration does include substances defined by the directive.
- Identify the substance(s) creating the non-compliance per packaging material.
- Have it signed by an authorized individual.
- Name, contact details and position must be included.
- Date the declaration.
- Declarations are likely to be rejected if they are more than one year old.
