Guidance on How to Apply for an Extension to EU RoHS Exemptions

Question Posed:

How can my company apply for an extension for Annex IV, exemption 1c? I believe we may be behind schedule based on the RoHS framework. Is there anything we can do to address this?

Answer Provided:

There is a process to apply for a new exemption, request an exemption extension or removal of an exemption.  New exemptions or requests for extension should be received 18 months prior to when the product will come in scope or before the exemption expires. Even though the time has passed, it is still possible to put in the request, but expect the exemption to expire prior to a decision being made to reinstate the exemption (should that occur). It will mean that your product will need to be compliant during the timeframe between decision or it will not be allowed to be placed on the market during the period it is non-compliant (while waiting for reinstatement).

Once you have decided that you want to request an exemption, the renewal, amendment or deletion of an existing exemption, you will have to do the following:

  1. Use the checklist below to understand what information and data you need to compile before handing in a request. (Checklist Documentation, Page 7)
  2. Fill out the application form (see appendix 1). (pages 12-17)
  3. Send the application form along with further documentation to the European Commission by e-mail or post:
